Terms and Conditions:

This agreement contains the entire understanding between JnK Imagery Inc. and the client. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all the parties.

RESERVATION: A signed contract and session fee is required to reserve the date and specified coverage or collection. In the event of a cancellation, postponement or if there is a breach of contract by the client, the session fee is non-refundable, and shall be liquidated damages to JnK Imagery Inc. The client shall also be responsible for payment for any of material expenses incurred for your session up to the time of cancellation (ie. deposits to hold the makeup artist, props or studio rental fees). 

COPYRIGHT and USAGE:   As the author of all images made hereunder and as provided for by law, JnK Imagery Inc. shall retain the copyrights in perpetuity, regardless of possession or ownership of negatives, photographs, digital files or any other format of reproduction. Use by The Client: The parties agree that The Client may use the images created hereunder to promote its own interest without limitation. This includes but is not limited to, the use of the images in printed materials, websites, signage, audio/visual presentations and public-relations distribution to media outlets for their editorial use. Use by JnK Imagery Inc.: The parties agree that JnK Imagery Inc. may use the images created hereunder for self-promotional, display, and educational purposes without limit to medium, date or geographic location. They may also be used for entrance into photographic competitions and release all claims to profits that may arise from the use of images. The Client agrees to indemnify and hold harmless JnK Imagery Inc. for any legal action arising from a third party as the result of The Client’s use of the images created under this agreement.

CANCELLATION/POSTPONEMENT: Forty-eight hours' notice of postponements or cancellations is appreciated but understand that in our current climate that may not be possible. If JnK Imagery Inc. is unable to fulfill this agreement in whole or in part due to any reason whatsoever including without limited the generality of the foregoing, due to illness, negligence, technical or mechanical failure, natural disaster, fire, an act of war or terrorism (domestic or foreign), epidemic or pandemic (including COVID-19), the action of any governmental authority (including a Government Order), a national or regional emergency, other casualties, an act of God, or other cause beyond the control of the parties, JnK Imagery Inc. shall not be held liable or responsible beyond the refund of money paid to JnK Imagery Inc. by the undersigned. The undersigned further agrees not to take any legal or other action against JnK Imagery Inc.. This agreement shall operate as a full and final release in any such action. The session must be rebooked within 30 days.

RE-SHOOTS: In the unlikely event that the client is completely dissatisfied with the final results based solely on personal preference, JnK Imagery Inc. will re-shoot at a 25% discount from the original session fee. The client is then able to order digital images from the second session only. In the unlikely event that the finished product from a portrait session is unusable due to technical problems, (camera failure or exposure problems), JnK Imagery Inc. will re-shoot at no additional charge.

COOPERATION/NO SHOWS: JnK Imagery Inc. is not responsible if the client and/or key individuals fail to appear or cooperate during the photo sessions, or for missed images due to details not revealed to JnK Imagery Inc. If the client and/or key individuals fail to appear to the scheduled photo session, the retainer is non-refundable. The session can be rescheduled at an agreed-upon fee, including an additional 50% deposit.

WEATHER: If it is not possible for a session to take place on a scheduled day due to weather, JnK Imagery Inc. and the client will reschedule on an agreed date at the earliest date possible, with no additional charge.

MODEL RELEASE: The client grants to JnK Imagery Inc. and her legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of the client, their business, the client’s child or children, or any other participants, in which the client may be included for editorial, trade, advertising and other purposes, and in any other manner and medium; to alter the same without restriction; and to copyright the same. The client hereby releases JnK Imagery Inc. and her legal representatives and assigns from all claims and liability relating to said photographs.
